<p>From the start, the proposed Río Blanco mining project in the Piura highlands has raised concerns about environmental impacts in the communities of Ayabaca and Carmen de la Frontera. Such concerns are a principal reason the "no" vote won the non-binding referendum on September 16.</p>
<p>Although Minera Majaz has not yet submitted its Environmental Impact Assessment (EIA), there is reason to be concerned about the area's environmental future, especially if Río Blanco proves to be just one part of a mining "district," or group of mining operations.</p>
<h3>Considering the risks</h3>
<p>First, mining is an activity with high environmental risks, as <a href="http://www.minem.gob.pe/archivos/dgm/publicaciones/pasivosmineros/DATA/ANEXO%20D%20RESUMEN.pdf">a list of hundreds of environmental liabilities compiled by the Ministry of Energy and Mines</a> reveals. While it is true that a given mining operation usually affects a local area in a concentrated and relatively small manner—according to the company, the total area to be directly affected by the Río Blanco project will be around 4,450 acres (1,800 hectares)—it is also true that aquifers can be severely affected many miles downstream.</p>
<p>The potential contamination of the Río Blanco has become one of the main causes of unease for the people in the area, given that the proposed mining project is located in the river's headwaters. The Río Blanco is a tributary of the Chinchipe River, which forms the most important valley in the neighboring province of San Ignacio, in the department of Cajamarca. According to the study <a href="http://www.perusupportgroup.org.uk/pdfs/Mining%20and%20Development%20in%20Peru.pdf">"Mining and Development in Peru, with Special Reference to the Río Blanco Project, Piura,"</a> written by a multi-disciplinary team led by Anthony Bebbington, professor of the School of Environment and Development of the University of Manchester, the most serious environmental problems that the mine could generate are "the leaching of acidic mine waters (AMW) from the mining site, the heaps of tailings, and the piles of excavated material." According to the study, the high precipitation in the area (2,000 millimeters (6.5 feet) or more per year) "raises the possibility that rainwater could filter through the piles of tailings and excavated material, transporting contaminated metals to both surface and underground waters." The study indicates that another worrisome potential problem is AMW contamination of the water table, because the open-pit mine would probably be deeper than the groundwater in the area.</p>
<p>After analyzing the environmental variables and reviewing the technical proposal by Majaz, Bebbington and his team concluded that "it would be possible to handle the environmental impacts of the project as designed," provided that this is an isolated mining project. If Río Blanco became part of a large mining district, the situation would be different and the risks to the environment, and water resources in particular, would increase considerably.</p>
<p>At the same time, the team had reservations, given that the proposed mining technology "has never been used in an area with as much precipitation or a history of seismic activity" and hence "the possible combination of tailings/wet excavation material and seismic activity is a reason for serious concern."</p>
<h3>Weak regulations</h3>
<p>Minera Majaz states in many of its official notices that using of state-of-the-art technology will protect the environment. However, simply complying with Peruvian laws, which are regrettably weak, is no guarantee of true protection from environmental contamination. Vito Verna, Director of the Indigenous Communities and Environment Program in the office of the Peruvian Ombudsman observes that "the Peruvian state apparatus lacks an integrated environmental policy. For example, each industrial sector has (or should have) its own maximum allowable pollution limits, and there should be national quality standard for water, soil and air. The system does not work because the ministries have not yet put these standards forward, and consequently the National Environmental Council (CONAM) cannot approve them."</p>
<p>As a result, Peru has approved standards only for air and non-ionizing radiation [such as emitted by radio waves, or microwaves], but not for water (the existing standard is obsolete) or soil. Although a mining operation is required by law to treat its waters before discharging them into a body of water, the maximum allowable limits are so lax that they could even be Class III—waters suitable for irrigation or livestock, but not to sustain aquatic life. Thus, in Peru, a mining operation could exterminate fish, amphibians, and other river wildlife without breaking the law.</p>
<p>But the potential environmental impact of the Río Blanco project does not end there. The project site, in addition to being at the headwaters of a river basin, is located in the heart of a vast area of high-altitude cloud forests—the last sizeable area of tropical rain forests remaining in the department of Piura. These forests have great value in themselves, owing to their diversity and the fact that they form an extension of the forests of Ecuador and Colombia, and thus contain flora and fauna rare in Peru. Yet their greatest value is the connection they provide between the Tabaconas Namballe National Sanctuary (SNTN) in neighboring San Ignacio, and protected areas extending to the Ecuador border. The Río Blanco forest creates a "biological corridor," serving populations of animals that require large areas to be viable, such as the spectacled bear and Andean tapir—two endangered species protected by law.</p>
<p>A large open-pit mining operation in the midst of these forests, and the resulting human activity, represent a threat to the very survival of this corridor. Without it, the spectacled bears and tapirs of the sanctuary, which would lack the space necessary to survive, would be condemned to extinction. A World Wide Fund for Nature (WWF) study of the biodiversity of the sanctuary and its neighboring zones concluded that "the protection of a biological corridor between the SNTN in Peru and the Podocarpus National Park in Ecuador is critical for the preservation of the species that inhabit those areas."</p>
<h3>The future role of mining in Piura</h3>
<p>A final consideration: Minera Majaz is not the only company interested in conducting mining operations in the area. A glance through the government's <a href="http://www.inacc.gob.pe/download/boletin/BOLETIN_2005/ATLASCATASTRAL/VISUALIZADOR.HTM">Cadastral Mining Atlas</a> reveals, in addition to the Río Blanco project, concessions of several thousand acres in Carmen de la Frontera. Many of these are adjacent to the Río Blanco project—forming, on the maps produced by the National Institute of Concessions and Mining Surveys (INACC), a solid block of mining concessions in the forests of the Yanta and Segunda y Cajas communities. In context, then, the Río Blanco project is just the first of many future mining operations, which, as a group, constitute a potential new mining district in Peru—and whose environmental impact would be considerably more serious and significant than any single project such as Río Blanco.</p>
<p>It is imperative that the Peruvian government consider all the environmental issues at play in the Río Blanco case, both as part of the dialog process following the referendum and when it evaluates the EIA that the company must soon deliver.</p>

<p>The referendum to voice approval or disapproval of a mining project on community land was carried out in Peru on Sunday, September 16, in the districts of Carmen de la Frontera, Ayabaca, and Pacaipampa. Voting was peaceful—without violence that could have inhibited public willingness to express an opinion.</p>
<p>According to published figures, of the individuals qualified to vote in the referendum, there was a turnout of 50.9 percent in Ayabaca; 59.1 percent in Carmen de la Frontera; and 70 percent in Pacaipampa. Consulta Vecinal reported that of 31,388 registered voters, 18,107 cast ballots—a turnout of roughly 60 percent overall. Of these votes, 17,033 said NO to the mining company and 285 said YES. There were 239 blank ballots and 460 disqualified votes.</p>
<p>"Participation has been successful and voluntary," said Fernando Romero, coordinator for Oxfam International. "We believe that the referendum has succeeded in allowing the people of these three districts to voice their opinion regarding the Rio Blanco project."</p>
<p>The referendum has brought to light the issues at the heart of the Majaz case. First, there is a weak or nonexistent state apparatus in Peru for dealing with such issues—making plain the need for an environmental authority capable of regulating and supervising corporate conduct. Second, there is an urgent need for a land-use plan that would identify sites suitable for mining projects.</p>
<p>After explaining that this is a non-binding referendum that would not translate into law, Romero went on to say that "the inhabitants of mining areas are interested in voicing their opinions and being heard by the authorities."</p>
<p>"This is a call for attention and a reminder that these communities are part of the country and should participate when decisions are made that affect their way of life and their future," Romero said.</p>

<p>Just a few days before the referendum organized by the mayors of three districts in Piura, in the area of the proposed Rio Blanco mining Project run by Majaz Mining Company, there is intense public debate. Comments on the referendum and mining in Piura from from ministers, entrepreneurs, and even high representatives of the Catholic church are in the media. Piura is latest epicenter of the sometimes conflicted relationship between large mining projects and communities.</p>
<p>Given everything this project represents for the government and the mining industry, all the attention is not surprising. This is a huge copper mine that will require an investment of about US$ 1.4 billion and that could export around US$ 1.0 billion a year for the next 20 years. The recent acquisition of close to 90 percent of the shares of the Majaz main company—the English junior miner Monterrico Metals Plc—by the Zijiin Mining Group Ltd. consortium, does nothing but add more weight in the balance for the development of the project, especially now that the Peruvian government wishes to sign a trade agreement with China.</p>
<p>The conflict, nevertheless, did not start this week, and the referendum that intends to collect the opinion of the local population about the continuation of the Majaz mine, is just the latest controversy. There have been a series of problems that have marked the presence of this mining company since it entered the scene in 2001.</p>
<h3>Early concerns</h3>
<p>From the beginning, the concerns about the environmental impact of this mining project have marked the tone and character of this debate. Located in the Huancabamba mountains, the mining concession area will cover a total of 6,473 hectares (about 18,858 acres) of deserts and cloud forests. The forests act like a sponge, collecting rain water and feeding it into the rivers that flow into the agricultural basins of Chinchipe (in Cajamarca) and Quiroz (in Piura). The communities of Yanta and Segunda y Cajas, under whose territories the copper deposit lies, immediately expressed their worries about the potential destruction of these fragile eco-systems and the effect on their agricultural lands. Soon other peasants and biologists from Piura joined in with concerns about the impact mining would have on the rich biodiversity of the area. The preliminary results of a recent study of the University of Texas made by researchers Kenneth Young, Blanca León and Julio Postigo confirmed their worries, when it found that a mine with an open pit of 1,000 hectares (2,450 acres) would cause alarming degrees of destruction because "it would cut connections among eco-systems (biological corridors), transcending impacts of local dimensions," and endangering species already threatened like the oso de anteojos or Andean spectacled bear and the altitude tapir. Majaz has not yet presented its Environmental Impact Study (EIS), which makes it difficult to know what plans they have to diminish these potential impacts.</p>
<p>But besides these environmental worries, another social problem that has legal implications must be added: Majaz never obtained the communities consent, required by law, to start the explorations in their territories. As it has been confirmed by the report N° 001-2006/ASPMA-MA of the Peruvian Ombudsman, the firm has not obtained the authorization of two thirds of the members of the communities found in the mining concession area. Recently, Andrew Bristow, operations manager for Majaz mine, has admitted that even if the firm had a document signed by leaders of both communities in 2002 authorizing the exploration activities, Majaz did not comply with the above mentioned legal requirement. It is not surprising then that the firm, after six years operating in the zone, has not obtained the social license required to operate a mine project. This fact was recognized even by Bristow, who has declared that the Río Blanco mining project "could be delayed if a social agreement with the communities where it operates is not obtained."</p>
<p>The social conflict reached its most critical moments in 2004 and 2005, when two demonstrations of thousands of community members coming from several miles around confronted police forces. Several peasants were injured in violent confrontations—some of them severely. Two died and more than 200 had lawsuits brought against them for taking part in the protests.</p>
<h3>Referendum and hostility</h3>
<p>A few days from the referendum, hostilities have started again. "The referendum is being politically manipulated. "...mayors from outside of Piura and international NGOs are involved," declared Bristow. And the government, which in almost all other similar social conflicts has supported the mining investors, has ignored communities concerns. The Prime Minister Jorge Del Castillo, who traveled to Piura on Monday September 3rd with Monsignor Luis Bambarén, bishop of nearby Chimbote, said that "a referendum cannot be used to veto an economic activity...because natural resources are the property of all Peruvians and do not belong to a district, community, or province." The minister of Energy and Mining, Juan Valdivia, said that "the interests of other countries are behind these entities [NGOs] that intend to delay the country's development." On the same note, the National Jury of Elections (JNE) has delcared this referendum illegal, and that it will start the legal actions against those who should be held responsible for "acts against the legal order."</p>
<p>The Ombudsman office and the National Council for Human Rights of the Ministry of Justice have expressed a different opinion, recognizing this is not an illegal procedure. The Ombudsman in particular said that these kinds of mechanisms are useful if they are oriented to "start processes that will build consensus which enrich the decisions of the state authorities."</p>
<h3>Dialogue</h3>
<p>Answering the JNE statements, the mayors of the zone have said that they are holding the referendum because the government will not engage in a dialogue with them. According to Javier Jahncke, from the Technical Table for the support of Majaz, "since January 2006 there were several initiatives for dialogue, but this year, with the authorities of the new government, it definitely stopped. That is why this referendum was conceived."</p>
<p>At the time of this report, the mayors of Carmen de la Frontera, Ayabaca, and Pacaipampa are determine to hold the referendum in their towns and reestablish some type of dialogue afterwards. The mining company has reiterated that the offer they made last August 15th of giving US$ 80 million as a fund for social projects and infrastructure in the communities, "is still standing." Prime Minister Del Castillo expressed his wish to build bridges when he declared in a press conference that the president of Zijin "has no intention of exploiting the mineral resources in the zone if they do not reach an agreement with the population."</p>
<p>Being so close to the referendum, the political and media pressure on the organizers will be, no doubt, very strong during these days. Above all, it is expected that the action will take place in calm and with transparency.</p>
<h3>Legal problems</h3>
<p>From a legal point of view, the most important aspect of the conflict between Minera Majaz and the communities is the lack of consent from the communities, required by law, authorizing mining explorations in their territories. In its report N° 001-2006/ASPMA-MA, released in November 2006, the Peruvian Ombudsman declares that the Law of Peasant and Native Communities states that all use of lands for mining activities, including exploration, must have the authorization of the communities who own the surface property, granted in general assembly and registered in an act signed but two thirds of the accredited members. If the community authorization is not obtained, the firm must wait until the state carries out a "serving procedure," in which the government of Peru gives the authorization and pays compensation to the community. According to the Ombudsman, this legal requirement has not been completed, because Majaz has not obtained the authorization of two thirds of the members of the communities over whose territories the concession is located.</p>
<p>As for the legal status of the referendum, the Nacional Jury of Elections (JNE), in a communiqué dated August 15th, stated that the referendum has no official character, and is also illegal because "no person, sector of the population, or organization, including a city hall, can arrogate the exercise of exclusive and non transferable faculties that constitutionally belong to the electoral bodies."</p>
<p>The Peruvian Ombudsman has declared that, even though these mechanisms do not have legal implications, meaning that the State is not forced to accept its results, the referendum is allowed under constitutional law and is not illegal.</p>
<p>Anthony Bebbington, an academic from the Environmental and Development School of the University of Manchester and main author of the study "Mining and development in Peru, with special reference to the Río Blanco Project, Piura,"" has observed that the deep discrepancy among the central government and the local authorities about which are the adequate ways to solve the conflict could be a sign that the democratic practice is failing. As Bebbington says, "it seems that there are no institutions that permit a point of a balance among local wishes and concerns, on the one side, and national wishes and concerns, on the other."</p>

This is the question that thousands of citizens will answer on Sunday September 16th in this and two other districts in northern Peru.</description>        <content:encoded xmlns:content="http://purl.org/rss/1.0/modules/content/"><![CDATA[
<p>This special referendum has been organized by the mayors of three communities, along with members of the Frente de Desarrollo Sostenible del Norte del Perú (Front for Sustainable Development of Northern Peru). The question refers to the development of the Río Blanco mining project, led by the Majaz mining corporation, whose largest shareholder is the Chinese consortium Zijin.</p>
<p>The proposed mining project has caused social conflict in this area of Peru. The problems started when the communities denied the company their authorization for the use of their lands, which the firm needs under Peruvian Law No. 26505. The Peruvian Ombudsman office verified this, and communicated the decision to the Ministry of Energy and Mining, which disregarded it. After that there have been several violent conflicts between the security forces hired by the company and community members, two of whom died.</p>
<p>In recent weeks, the Zijin consortium has offered $40 million to the community of Yanta, and the same amount to the community of Segunda y Cajas, to be paid over the duration of the mining project. The latter community held an assembly and decided not to accept this proposal, which conditioned the disbursement to the approval of the mining project. The former will decide in the following days.</p>
<p>"This plebiscite is taking place because the population has asked for it," said Fernando Romero of Oxfam International. "The citizens of this zone want to express their opinion about an activity that would profoundly affect their lives. This action respects the right to express one's opinion, a very fundamental right," he added. "Oxfam International decided to support the referendum because it is a legal mechanism that does not pretend to go further than what the law recognizes as a matter for local governments, as it has no legal implications. We think it is crucial to collect the communities' opinion and establish a dialogue between the authorities, firms, and civil society." Romero emphasized that, according to Oxfam's experience, only by listening to the population can social conflicts be mitigated.</p>
<p>In the last few days some Peruvian authorities have publicly criticized the referendum. The National Election Board, the body that regulates elections, has declared it an illegal activity because local authorities are not supposed to hold referenda in which citizens decide about extractive industries. The Ministry of Energy and Mining has said that local authorities cannot make declarations on a national issue. President Alan García and the Prime Minister Jorge Del Castillo have publicly opposed the referendum.</p>
<p>Nevertheless, the office of the Peruvian Ombudsman has declared that the referendum is not an illegal activity because it is within the jurisdiction of the local authorities. The Ministry of Justice has made similar statements. The organizers have stated that the referendum lies within the responsibility of the local government, and that it is meant to reflect public opinion, which they want the authorities to consider when it is time to make decisions.</p>
<p>"We make a public call for this activity to be held in peace, for the different points of view to be heard, and for the authorities to give the necessary help and make sure there is adequate security for everyone," said Romero. "Oxfam is opposed to any type of violence or coercion and supports freedom of expression and participation for everyone involved. We expect this opportunity will be used to hear the population's opinion and find the best solution for the social conflict that has been brewing. The communities of these three districts have sought a way to express themselves in a peaceful way, and this is a will and a right that should be respected."</p>

<p>Ecuador's new President Rafael Correa put a spotlight on the legal case brought by the <a href="http://www.texacotoxico.org/eng/">Amazon Defense Front</a> and 30,000 people against ChevronTexaco, leading a group of journalists to the area near Lago Agrio late in April, where the company spilled more than 18 billion gallons of oil and toxic waste water over nearly three decades.</p>
<p>According to an <a href="http://www.chevrontoxico.org/article.php?id=358">Associated Press story</a>, President Correa publicly pledged government support for the case, which began nearly 10 years ago in the United States and was thrown out on appeal in 2003. Since then the court in Ecuador has been conducting judicial inspections of polluted areas, gathering evidence a judge will use to make a decision, possibly in the next year.</p>
<p>During the same week, indigenous leaders representing the people affected by the pollution in the Orellana and Succumbios region of Ecuador attended the annual meeting for shareholders of ChevronTexaco in California. <a href="http://www.oxfamamerica.org/whatwedo/where_we_work/south_america/news_publications/texaco/feature_story.2005-01-17.8659829209">Humberto Piaguaje</a>, a leader of the Secoya indigenous people, called for the company to resolve the case and help clean up the environment. "We want you to give us back our lives," Piaguaje said. "We want you to let us live in peace and harmony with nature. We want you to repair the damage so that our children do not have to continue suffering."</p>
<p>Oxfam America has supported the Amazon Defense Front's legal case for nine years, and assisted in the creation of the Assembly of Delegates of Communities Affected by Texaco, a community-based organization that has ensured those most directly affected by the pollution have a voice in the legal strategy.</p>
<p>"We think it is positive that President Correa has declared his support of those affected by pollution in the Lago Agrio region," said Javier Aroca, who coordinates programs related to indigenous rights for Oxfam America in South America. "We consider this is a signal that the government is interested in investigating and sanctioning those who are responsible."</p>
<p>"It is important to remember that the people affected are demanding compensation for almost 10 years now," Aroca said. "The pollution has affected the health of indigenous peoples and peasants... there have been cases of skin diseases and cancer. Furthermore, the lands are not as productive as they used to be, which has affected the agricultural economy. From our point of view, the government of Ecuador should support the affected population to complete the legal procedures, which are very expensive."</p>
<p>A win for the Amazon Defense Front in this precedent-setting case could change the landscape of the oil industry, and further establish the rights of communities to be compensated for negative social and environmental effects of oil operations.</p>

<p>At 1:30 in the morning on March 15th, 2008 Javier Jahncke, an environmental and community rights advocate in Piura, Peru, received an anonymous death threat by telephone. This is the latest in a troubling series of threats and attacks on human rights advocates in Peru who are engaged in defending the rights of communities affected by mining operations.</p>
<p>Oxfam America and Peru's National Human Rights Coordinating Body are both publicly denouncing these threats and expressing concerns about the safety of the individuals being intimidated. Oxfam America calls on the legal authorities to protect these individuals, and investigate the death threats and attacks.</p>
<p>Javier Jahncke is the coordinator of a technical support team that advises communities affected by the Rio Blanco mining project in the Huancabamba and Ayabaca provinces of the department of Piura. Jahncke is also a member of FEDEPAZ, one of Oxfam America's partners, as well as the Muqui Network, which is an association of national and local organizations working on the environmental and social effects of mining.</p>
<p>The Rio Blanco Project is run by the Majaz Mining company, an affiliate of the British Monterrico Metals company. Critics of the Rio Blanco project contend that mining could transform an environmentally fragile area of cloud forests and high plains into a mining district that will degrade natural resources and pollute the Piura and Chinchipe rivers. (The Chinchipe is part of the Amazon Basin.) Peru's Public Defender office (a government ombudsman agency that protects the rights of citizens) has said that the mining company started the mining exploration project without the approval of the communities, as required by law.</p>
<p>Civil society groups including the Front for the Sustainable Development of the Peruvian Northern Border have proposed community consultations so that people can express agreement or disagreement with mining activities on their lands. The Front is formed by representatives of farming communities, social organizations, the mayors of the Provinces of Ayabaca and Huancabamba, in Piura, and of Jaén and San Ignacio, in Cajamarca. Javier Jahncke is member of the technical team that advises the Front.</p>
<p>FEDEPAZ has for several years assisted the communities of Ayacaba and Huancabamba in filing claims of illegal land seizure by the Majaz Mining Company.</p>
<p>The death threat against Jahncke is the latest in a series of threats and attacks against community rights advocates in Peru:</p>
<p>In December 2006, Father Marco Arana of the GRUFIDES organization in Cajamarca was being followed, threatened, and intimidated in retaliation for his work advocating for the rights of communities affected by mining.</p>
<p>In February 2007, a man driving a car shot at, but did not hit, Nicanor Alvarado, coordinator of the Environmental Apostolic Vicarage of Jaen, a member of the Muqui Network.</p>
<p>Oxfam America has joined with Peru's National Human Rights Coordinating Body (Coordinadora Nacional de Derechos Humanos del Perú) in expressing concern for the safety of environmental and community advocates, and calls on all sides of conflicts related to mining projects to resolve them through dialogue and other non-violent means.</p>

<p>Do institutions like the World Bank need to consider international human rights when they make loan decisions? Or are human rights merely political considerations that are outside the scope of responsibility the Bank and other financial institutions?</p>
<p>These were the questions taken up by the Organization of American States' Inter-American Commission on Human Rights in a special session to discuss "Human Rights Violations and the Responsibility of International Financial Institutions."</p>
<p>Financial institutions like the Inter-American Development Bank loan huge sums to governments and companies in Latin America. In 2006 it provided more than $6 billion for 112 projects. World Bank lending in the region was more than $5 billion in 2005.  Yet despite the power to affect the lives of millions across the region, these bodies have always claimed they are not bound by international human rights law.</p>
<p>"This was the first time the Inter-American Commission on Human Rights has held a hearing on this topic, and they seemed quite enthusiastic about becoming more engaged on the issue," said Ian Gary, Oxfam America's policy advisor on extractive industries. He delivered remarks specifically on the $1.7 billion Camisea gas pipeline in Peru, which benefited from $135 million in financial support from the Inter-American Development Bank. Broader legal arguments regarding the need for international financial institutions to comply with human rights norms in their projects were made by representatives of the Indian Law Resource Center and the Center on International Environmental Law.</p>
<p>Critics of the pipeline charge that it runs through national parks and environmentally sensitive areas of Peru without the proper consultation of indigenous communities living there, a violation of the International Labour Organization's Convention Concerning Indigenous and Tribal People in Independent Countries. The five spills since the pipeline was completed in 2004 have affected the right to a livelihood of indigenous communities – communities say project impacts have contributed to a decline in fish stocks and access to wild game.. A delegation of NGO representatives led by Oxfam America visiting the pipeline area in 2006 were told by local groups that little of the gas royalties given to local government had been used for social programs, such as schools or health clinics, to help the indigenous people in the area.</p>
<p>"This hearing was an important first step to bring public agencies like the World Bank or the Inter-American Development Bank within a system of accountability to address human rights abuses," Gary said. "Our prospects for sustainable reforms are greatly enhanced when we support local partners to defend their rights and, at the same time, make these arguments in important venues such as this."</p>
<h2>Inter-American Commission on Human Rights Hearing on Multilateral Development Banks and Human Rights</h2>
<h3>"The Inter-American Development Bank, the Camisea Gas Project and Human Rights"</h3>
<p>Oral Presentation by Ian Gary, Policy Advisor for Extractive Industries, Oxfam America, March 1, 2007</p>
<ul>
<li>The World Bank Group and the Inter-American Development Bank (IDB) provide significant amounts of financial and technical assistance to Organization of American States Member States with the purpose of promoting investment in the region and contributing to economic growth and poverty alleviation.  In 2006 the IDB provided the largest amount of multilateral lending for Latin America and the Caribbean, approving over 112 projects totaling close to $6.4 billion.</li>
<li>Despite the enormous influence that the World Bank Group and the IDB wield in the region, these international financial institutions have long asserted that they are not bound by international human rights law because their Charters, known as Articles of Agreement, do not include explicit references to human rights.</li>                                                                      
<li>The case of the Camisea natural gas project in Peru, funded by the Inter-American Development Bank, illustrates the impacts on the full range of human rights that can result from IFI-financed activities.</li>
<li>The Camisea project, a $1.7 billion investment, is one of the most controversial energy projects in the world, taking place in a region of notable biodiversity, national parks and reserves, and the home of recently contacted indigenous communities and indigenous communities in voluntary isolation.</li>
<li>(By way of introduction, Oxfam America has worked with indigenous communities in the project zone for more than a decade and has supported indigenous federations in the project zone, in addition to policy and research work in Washington. I organized a high-level delegation from Washington to visit the project zone in April 2006.)</li></ul>
<h3>Camisea project background</h3>
<ul>
<li>Companies – upstream operator Pluspetrol - Argentina (40%), Hunt – U.S. (40%), SK Corporation – South Korea (20%) – downstream TGP/Techint operator - Argentina</li>
<li>Location of blocks in Lower Urubamba - 75 percent of the producing Block 88 is located in the Nahua Kugapakori reserve for isolated indigenous people.</li>
<li>Pipeline became operational in August 2004</li></ul>
<h3>Role of IDB ($135 million A and B loans) and justification</h3>
<ul>

<li>Syndicated B loan of $65 million</li>

<li>Value added – bring higher standards to companies and government</li>
<li>U.S. Export Import Bank declined based upon woefully inadequate environmental impact mitigation measures</li></ul>
<p>Indigenous groups, Peruvian and international environmental and human rights NGOs expressed serious concerns about the project prior to the IDB's decision to co-finance the project. Unfortunately, many of the concerns related to the rights of indigenous peoples and environmental damage have been borne out.</p>
<h3>A few examples of violations of human rights:</h3>
<ul>
<li>Communities in the project zone did not have the right to Free, Prior and Informed Consent as enshrined in ILO Convention 169.</li>
<li>Problems with consultation included a lack of information prior to consultations</li>
<li>Low levels of compensation for communities providing pipeline right-of-way, etc.</li>
<li>Five spills in first 18 months of operation – A February 2006 report by E-Tech International, a non-profit engineering consultancy, alleged that the pipeline was constructed, in part, by unqualified and untrained welders using corroded piping and rushing to avoid onerous late completion fees that would have totaled $90 million.</li>
<li>Loss of livelihoods – Examples include:
<ul>
		<li>Soil erosion and increased river traffic have been blamed by communities for decreased fish stocks</li>
		<li>Hunting has been affected by noise created by helicopter overflights</li>
		<li>Health impacts, including the introduction of new diseases</li>
		<li>A May 2004 report, published by the Peruvian health ministry's General Office of Epidemiology noted that incidences of infectious diseases had increased in the reserve among one isolated group, the Nanti, 25% of children now reach adolescence</li>
		<li>There has been little in the way of increased social spending on the part of the central and local governments, in part due to extremely low capacity levels on the part of local governments to manage funds and execute projects. In 2005, the Municipality of Echarate received around $22m in gas royalties but has had difficulty programming these funds.</li>
		<li>There has been no independent monitoring system for the project put in place.</li></ul>
</li>
<li>IDB is currently undertaking due diligence for the second phase of the Camisea project (referred to by the IDB externally as "Peru LNG") which involves the construction of an Liquid Natural Gas export plant, additional pipelines and the development of gas fields in Block 56, adjacent to Block 88.
<ul>
		<li>While the IDB says its new Indigenous People's Policy will be observed for the second phase, there are concerns that the IDB is refusing to address the lessons and problems of Camisea before embarking on $400 million in financing for a second phase later in 2007. It remains to be seen whether the IDB will repeat the mistakes of the past and contribute to more human rights violations in the Peruvian Amazon.</li></ul>

<p>The air was still that Friday afternoon as we sat wilting in the sun, facing some 30 members of the community of Sensa, all indigenous people living deep in the heart of the Peruvian Amazon. A nearby mule screeched over the hum of a distant chainsaw. We were discussing a community garden and fish-pond project Oxfam America had recently funded, and my colleagues and I were there to learn from the people of Sensa how it had helped them and what more they expected from our support.</p>
<p>A woman in her 30s looked up from the floor, directed her gaze at me, and spoke. "Señorita," she began respectfully, yet ready to speak her part. "These projects you have helped us with are good. We are growing fish, and our gardens are healthy. But, a real concern to me is education. After completing the 6th grade here in the community, where will my children go to study?" She explained that she does not want to send them away to boarding school, but that she wants them to be educated "so that they know who they are, and what they can do." She proceeded to ask us to help them build a school.</p>
<p>This is a big request. I had to explain that Oxfam is not in a position to build schools in every rural Amazonian village. And once built, they need to be staffed with properly paid teachers. Schools also need books, desks, chalkboards, qualified teachers and to be maintained—every year. Funding a school from outside the community can be risky. A well-meaning donor could cover some construction and other costs. But as the years go by, if there is no viable local structure to foster education, who will be responsible for the school?</p>
<p>However, I continued, the people of Sensa have a basic right to quality education for their children, and we would consider supporting their efforts to claim that right in collaboration with the communities farther down the river. This would involve organizing these communities, and forming allies with others outside the Urubamba river valley. In this way they could reach out to the local and national government, who are responsible for education, and advocate for decent schools that will endure.</p>
<h3>Poverty in a rich land</h3>
<p>The contrast between the poorest indigenous people in Peru and the fantastic wealth in timber, gas, and minerals coming from their lands is stark. While the local government builds fancy offices for itself down the river in Echarate with oil and gas money, villages like Sensa, where the resources are extracted, have no electricity, telephones, or health clinic.</p>
<p>The indigenous people in these villages do not always understand their rights to a fair portion of these revenues in the form of basic services like health care and education. And if they do, they may not have the means to verify that they are getting their fair share. They usually lack the skills and political connections to hold accountable a government that has never shown it is open to the concerns of its native peoples.</p>
<p>"You do not want to be beggars, saying 'We are poor, give us money. Take care of us,'" said my colleague Igidio Naveda, himself an indigenous person from the Andes of Peru and a passionate, highly experienced program officer.</p>
<p>"No—you are indigenous people," he continued. "You have your culture, your traditions; you love your land. You have rights and need to demand them and ensure that they are met. And your lands: these are your home. Would you walk into someone else's home and take their things, leave a mess, disrespect the place? You should demand that the loggers in the area, the gas companies, the government workers respect your rights, and knock at the door before coming in. You need to lay out the rules and make them follow them."</p>
<p>Heads were nodding and people began to speak to one another in their Yine language. The group became animated, some laughing, others speaking intensely, gesturing as they sat at the wooden tables.</p>
<p>We concluded the meeting soon thereafter, inviting a new and more ambitious funding proposal from them, developed together with the chiefs of the other three nearby communities that had participated in the current project. A proposal like this would show that the community is moving to the next level of organization: The villagers will need to coordinate the project with other communities, and create effective ways to encourage the local government to meet its obligations. They will also have to address the illegal logging and other threats to the environment coming from outside the community.</p>
<h3>Building on success</h3>
<p>From my perspective, last year's project was a success. It helped indigenous communities manage their local biodiversity and begin to increase their food supply. That, in turn, served as a catalyst for them to become organized and collectively determine their priorities. This greatly strengthens their control over local development efforts, and increases the likelihood that new projects they pursue will succeed.</p>
<p>Although they may lack the advocacy skills needed to get the government to meet its obligations to educate their children immediately, we know the right organizations that can train them. Once people know their rights and are educated, they are better able to hold their leaders accountable. This knowledge and sense of empowerment can never be taken away. It is one of the best investments you can make, because it helps people learn to solve their own problems—they create a vision for the type of future they want for their village, set their own priorities, and make sure that they are met.</p>
<p>Hoping to reach the next community before dark, we excused ourselves from the welcoming community of Sensa, slipping down the muddy river banks to our canoe, with children trailing us on all sides, teasing each other and, laughing, no doubt at the spectacle of the four outsiders that had come to visit. The sun had moved sideways along the river and the tree tops were shining with a golden light. As the first mosquitoes of the evening reached us in our boat, we pushed off and continued downstream, eager to see what the next community had to say.</p>

<h3>Please tell us about the Secoya people.</h3>
<p>My grandmother told us that we were many, many Secoyas, between the Rio Napo and Putamayo, near the frontier with Colombia. We must have been over 8,000 there?</p>
<p>At the time of the Spanish conquest many people died from measles and mumps. And even when my grandma was a little girl, she had to escape into the jungle to avoid such terrible diseases. She said that nobody came to help them; people were dying in their houses, like chickens.</p>
<p>Then came the rubber boom. The rubber producers held the Secoyas as slaves. Many Secoyas drank poison to liberate themselves from the indignity of forced labor. Others fled deeper into the jungle.</p>
<p>After all this dislocation the Secoyas regrouped in about 1970. We were only 120 people. And those remaining 120 people, along with their children and grandchildren, were the ones who had to endure the impact of the oil companies. And of those 120, I was one.</p>
<p>This is to contextualize what is happening today. These 120 continue to suffer. Two [just] died of cancer, and eight years ago more people died of cancer. So we wonder, for those 120 native people and their descendants, if our days are numbered too; if some sickness will take us instead of a natural death. This is to say that life is uncertain now.</p>
<h3>What has been the impact of oil development on the culture and life of your people?</h3>
<p>The oil companies have had a significant cultural impact, especially on our territory. How we used to live—naturally, that is—is no longer natural. We are experiencing the impact of many other cultures, especially from [modern-day migration]. Before we didn't need money because we had everything we needed. There were animals and fish; there was fruit, and medicines. Everything was found in the forest. But now we must go out to buy everything.</p>
<p>We also need to buy notebooks and school supplies. We are now surrounded by school walls in order to learn. The education beforehand for the Secoyas began at four in the morning. The elderly people in the community worked with the young people, teaching them weaving. They also told stories, legends, which taught respect for older people.</p>
<p>Though we agree that education should take place in the classroom, we are not in agreement that the only thing that should be taught is what the government decides should be taught. We see that we are not educating ourselves and our children in the way that our ancestors taught us. In that sense we are losing our culture. Now the youth doesn't know about our legends and our stories and our customs. And this is why now, through our own bilingual education, we are trying to reintegrate our own values, our own cultures, and our own traditions into our education.</p>
<p>Another great impact is on the environment. For example, we no longer have animals because one step behind the oil companies came the colonists. And every time the colonists found an animal they had to shoot it, they had to kill it. [The animals] withdrew farther and farther away. And now we no longer have territories in which we have everything we need around us; in which we can go from one side to the other. Everything has its owner. Now there are other communities—Shuar communities and Kichwa communities—which were ours before. This is a reduction of our territory. Right now we're enclosed and circumscribed by different pacts. There is one pact with the oil company; the African palm company [harvesting hearts of palm]; the colonists; even other indigenous people who have migrated here from their ancestral homes in other provinces.</p>
<p>What has really damaged us is the pollution in the rivers. This is really the worst part, along with the contamination in the air and the earth itself on which we cultivate our plants and our food. These are the terrible effects that have been visited upon us.</p>
<p>Although we talk about remediation, I think it will be difficult to repair what has been damaged. I think perhaps we will never be able to, because even though we might repair the natural environment, modern society is here among us—on our doorstep—and we will never be able to repair that.</p>
<p>We have seen many new sicknesses that we didn't see in our people before. We the Secoyas knew how to cure ourselves when those sicknesses were natural sicknesses. But now, with these unknown diseases, not even the best healer among us knows how to cure them. I think if we don't now have people who really know how to cure those previously unknown diseases, if we don't resolve this case against Texaco, then the very few Secoyas that remain—about 400 of us—will lose our culture and we may be finished off by sickness or disease. Or for other reasons we will disappear bit by bit. This is what I can tell you about the impact of the oil industry on the Secoya people.</p>
<h3>Can you see a resolution of the Texaco case that could help your people survive?</h3>
<p>Yes there is a hope for us, in the way that we have been organizing around Texaco because the Sionas, Secoyas, and Cofanes, we are the ones who have lived here in Sucumbios. We are the original owners of these territories and we have seen all of the damage that has been done here. So we organized through some friendly organizations—they came and told us about human rights—before we knew nothing about human rights. And through friends and allies the Sionas, Secoyas, Cofanes, and Kichwas started to organize in order to bring justice to this case.</p>
<p>We, as one part of the affected people, believe that since we have already waited 10 years [while the case languished in the United States courts]; we could wait and continue another 10 years if necessary. This is our priority. People are saying: "If we don't get this resolved, what are we doing? If we can't drink the water from our traditional sources—then what?"</p>
<p>So we are newly united since the case has been presented in a court here, and now we are just waiting for the judge's decisions. We are assisted by Oxfam America and other people. We feel we are engaging in common work to ensure a future for the people who are in danger of disappearing.</p>
<p>We can't waste time being sorry about what has happened. We have to be able to defend and exercise the same rights as Spanish-speaking mestizo people do in our own territory.</p>

<h3>We're in the judicial inspection phase of the Texaco case. What do you see as being the next step?</h3>
<p>I don't anticipate a lot of difficulties in the judicial inspections phase, except for the financing of the inspections. The evidence provided by the judicial inspections is the fundamental basis for the case. The evidence must be supported scientifically, and this is expensive. If there?s not enough money to carry out these tests, I anticipate serious problems, and we run the risk of losing the case.</p>
<p>With the legal process itself, I don't foresee difficulties because the laws determine the process that should be followed, and the Judge will make a decision based on what the law says. He needs to determine his decision according to the law.</p>
<p>As for the final sentence: I will reserve judgments about what I think might happen. Unfortunately our courts have weaknesses, and there are many examples of corruption and political influence and political pressures on the legal system. For example, at our conference today we just heard the delegate from Ecuador's Ministry of Foreign Commerce say that the US government asked for the Texaco case to be dropped as a condition for negotiating a free trade agreement. Although the government has publicly said they do not accept this position, we are certain that pressure will be applied to the judge to decide in favor of Texaco. And that is very dangerous because for me what is at stake is the dignity of the Ecuadorian Amazon and the dignity of the justice system.</p>
<p>The only thing that I hope for in the Texaco case is that justice can be done. Those of us who live here have a great opportunity to demonstrate to the rest of the country that we are men and women with rights equal to those of others.</p>
<h3>Why did you become a lawyer and decide to work with the Amazon Defense Front?</h3>
<p>Since I was very small, I was always searching for justice. When I was 14, and my parents migrated from Esmeraldas, where we lived before, here to Sucumbios, I worked in an African palm plantation company for four years. Afterwards I worked for an oil company, also for four years, and in both places I saw great injustices with the workers and the campesinos. I also saw grave destruction of the environment. I shared these concerns with others, and so about six young people (I was just 17 at the time) agreed, we said "we must do something about these problems." Some were colleagues from work, some were friends from school, and others were from a church youth group. So when we got together and started to take actions with protests and complaints or simply pointing out problems and suggesting solutions, I got into trouble. That was the reason they fired me from the African palm plantation company. Then the oil company threw me out for defending the rights of other workers.</p>
<p>And so from this experience came my dream, my idea, to become a professional. A lawyer. To defend those like myself and others who would be denied their rights, especially for rural people.</p>
<p>Fortunately the church supported me for about 12 years. When I was left without work in the companies, the church gave me work so that I could continue with my studies and social service. I worked with the church until about one year ago when I was hired by the Amazon Defense Front.</p>
<h3>You had to overcome many obstacles to become a lawyer, didn't you?</h3>
<p>The first obstacle and the most important one was the economic obstacle. My parents provided education for me until [eighth grade]. From there on I had to do it on my own—to study and to work. So I worked during the day and studied at night. And when I entered the university, the church helped me by providing more than half of the tuition. That was not easy for them. And it was very difficult for me as I simply didn't have the money. Out of 10 brothers and sisters, I am the only one who finished high school, because of a lack of resources.</p>
<p>The group of friends that I mentioned before also helped me. And I also took other jobs. I worked for the radio doing the news, and as a professor in a distance learning program. I had to study from four until seven in the morning. Then I had to go to work until six at night. The time I had free for lunch midday I dedicated to doing news on the radio. At night I taught high school classes, so my work day was from four in the morning until 11 or 12 at night. That was how I got to this point.</p>

<p>The proposed Tambo Grande mining project in northern Peru offers a stark illustration of the problems associated with large-scale mining operations in an era of deregulation and globalization. The town of Tambogrande is poor, isolated and in the heart of Peru's "El Niño" zone. It sits directly atop a major gold, zinc and copper deposit that Manhattan Minerals, a small Canadian mining multinational, is seeking to develop into an open-pit mine. Projected impacts of the mine could be severe. Construction of the mine would require the relocation of an estimated 8,000 inhabitants of a total population of between 14,000 and 16,000 people and the diversion of a local river. The project could also have significant impacts on agricultural production in the area. Tambogrande farmers are Peru's principal mango exporters and the area has become one of Peru's leading agricultural centers thanks to major investment in irrigation systems, some of it provided by the World Bank.</p>
<p>Concerned by the proposed relocation and by threats to their agriculturally based livelihoods, local populations have mounted significant resistance to the project. On February 27 and 28, 2001, an estimated 10,000 people participated in blocking road access to the exploration site. A recent initiative collected approximately 28,000 notarized signatures of individuals in the Tambogrande district, of approximately 37,000 eligible voters, who are opposed to the mine. Tambogrande's Mayor and local Archbishop have called for the project not to go forward, citing not only the potential environmental impacts, but the mine's<br />disruptive social impacts, already evident in the exploration phase due to the tense environment of distrust and conflict that exists in the area. The archbishop has called the project "socially unviable." These actions represent significant opposition to the proposed mine by affected citizens and community leaders.</p>
<p>Manhattan Minerals, a mining "junior" with no previous experience operating a mine of this size, and no other current projects, rode into Peru on the wave of the country’s recent mining boom. With the privatization of Peru's mining sector in the early 1990s, foreign investment in the sector has exploded over the past decade. From 1992 to 1997, the volume of mining operations in Peru tripled from 30,000 to 100,000 metric tons of minerals per day. Land area devoted to exploration and extraction increased from 4 million to 18 million hectares between 1992 and 1998. According to the Financial Times, Peru has had South America's highest rate of exploration success in recent years, driving Latin America's emergence as the most popular continent for new mining projects. The Tambo Grande project is located in the department of Piura, a department that up until now has not been known for mining, but rather agriculture. Manhattan's operation may open the door to the exploitation of hundreds of thousands of hectares currently under concession in Piura. The impact on traditional agricultural livelihoods, from which the vast majority of Piurans draw sustenance and income, could be significant.</p>

<p>WASHINGTON, DC — Oxfam America applauds critical action by the Peruvian Congress to uphold the right of indigenous people to decide how development projects impact their lands and livelihoods. The Congress held a meeting with indigenous leaders and decided to revoke two legislative decrees that threatened the protection of community ownership of lands in Peru.</p>
<p>Legislative Decrees 1015 and 1073 were enacted by Peruvian President Alan Garcia as part of a package of reforms created for the implementation of the Free Trade Agreement between the United States and Peru. The two decrees, designed to encourage international investment in mining, oil, and other industries, violated the rights of indigenous communities that are guaranteed by existing national law. The decrees endanger their land ownership, restrict their right to consultation, and exceed the limits of the responsibilities that had been delegated to the government. The Congress recognized these abuses and overturned the decrees.</p>
<p>?The Peruvian Congress made a crucial move to protect the rights of indigenous communities,? said Raymond C. Offenheiser, president of Oxfam America. ?Communities were not consulted during the formulation of these decrees, even though the legislation would directly affect their land ownership and jeopardize their quality of life.?</p>
<p>The Peruvian Congress found the decrees in violation of indigenous rights, which are guaranteed by existing Peruvian law. The decrees would have reduced the number of votes needed to authorize the sale of land and would have limited access to lands that indigenous people could claim as their own.</p>
<p>This decision followed a series of demonstrations by indigenous organizations opposing the decrees and protesting the absence of adequate prior consultation with affected communities. Among the leading opposition organizations was the Inter-Ethnic Development Association of the Peruvian Amazon (Aidesep). Oxfam works with Aidesep on intercultural education programs and development programs that aim to strengthen capacity, awareness, and knowledge of rights. Oxfam did not support or play a role in the demonstrations.</p>
<p>?Oxfam believes that peaceful dialogue between citizens and leaders is the most effective tool for resolving conflict and ensuring that all actors are heard equally,? said Offenheiser. ?By declaring the proposed legislation unconstitutional, the Peruvian Congress recognized the validity and necessity of the people?s right to be heard.?</p>
<p>The Peruvian Congress took a step forward to prevent resource depletion in the Amazon region and uphold indigenous land rights, but there is still much work to be done. President Garcia must ratify the decision to revoke decrees 1015 and 1073, and he has yet to do so. These decrees are part of a package of 99 reforms that the government enacted as part of the legislative power it was given to implement the Free Trade Agreement. More than half of these reforms have been found unconstitutional by a study commissioned by Oxfam International. For example, Legislative Decree 1064 eliminates the need for an agreement between landowners and mining and oil companies and contradicts existing Peruvian law.</p>
<p>The Peruvian Congress, which criticized the administration for not consulting with the indigenous community prior to enacting the decrees, has agreed to set up a series of meetings with indigenous representatives with the goal of finding alternatives to these decrees that are acceptable to indigenous peoples.</p>
<p>?Indigenous communities of Peru have unique ties to their lands, which are central to their identity, culture, and quality of life,? said Offenheiser. ?The right to decide how their lands are developed is critical to their ability to protect their traditions and maintain their livelihoods.?</p>
<p>Oxfam America has been working on development activities in Peru for more than 20 years, supporting the groups that have the least access to economic resources in the country.  During this time, Oxfam has supported—in Peru and around the world—indigenous communities in the areas of bilingual education, productive projects, sustainable natural resource management, collective rights, and the preparation of local development plans.</p>
